Terms and Conditions

The rules that apply when you use BUBLE.

Last updated · 6. Oktober 2026

Escarcha Beheer B.V. · Version 2 · Applicable to users in the European Economic Area

Effective date: 6 October 2026 (replaces version 1 of 30 April 2026)

Escarcha Beheer B.V., established in Utrecht, the Netherlands, registered with the Dutch Chamber of Commerce under number 73367710 (“Escarcha”, “we”, “us”), provides the Buble Messenger app and services (“Buble” or the “Service”) under these terms of service (“Terms”). We need your agreement to these Terms in order to provide the Service.

Read this first. Buble is made for children to learn to use messaging and social media safely. A child cannot enter into a contract with us. These Terms are therefore accepted only by a parent or legal guardian, who in doing so acts on their own behalf and on behalf of the child, and takes on responsibility for the child’s use. Read these Terms together with your child and make sure you both understand them.

In short, for children

  • Your parent creates your account and decides who you can chat with.
  • Be kind. Bullying, threats, and mean, scary or rude messages are not allowed.
  • See something upsetting? Press the shield and say what happened; your parent, your teacher or your trusted person will see it. An adult who is being unkind, you can block.
  • If someone breaks the rules, we can remove a message or moment or pause an account. Your parent will get an explanation by e-mail and can object.
  • If your parent reads along, you can see that in the conversation, and so can the other person.
  • A message you delete can still be seen by your parents (if they read along) and by Buble (if there is a report) for 30 days.
  • Buble is not for emergencies. In danger? Call 112 or find an adult.

1. About our Service

  • What Buble is. Buble is a messaging app in a protected environment where children can exchange messages, photos, voice messages and group chats with contacts approved by their parent, make one-to-one calls (voice and video), play games together, and place a moment (text or photo) that only their own contacts can see. There is no public timeline. Only in the game leaderboards can a child be visible to others, and only if the Parent turns that on (section 5). Children aged 6-8 can only choose from ready-made sentences. Parents manage the account through the parent account and can approve contacts, change settings, set a daily time limit and receive notifications. If the Parent turns it on, the Parent can read along with conversations and view the child’s current location for as long as the Parent has the location screen open; the child can see in the app which of these features are on, receives a notification when the Parent turns them on or off, and has a log of when which Parent viewed which conversation or tracked the location. When a Parent reads a message, everyone in that conversation can see this next to the message, including the other participant and their Parent. A Parent can also propose another adult as co-guardian of the child (co-parenting); once accepted, that adult has the same rights.
  • What Buble is not. Buble is a learning tool and a communication tool. Buble is not a supervision service, not childcare, not a care service and not a substitute for parental supervision. We do not read conversations by default and do not guarantee that unwanted contact, inappropriate content or bullying will always be prevented or detected.
  • Safety and integrity. We work to keep the environment safe and act against misuse of the Service in accordance with sections 5 and 11.
  • Infrastructure. To provide the Service we store data with hosting providers in the European Economic Area. See the Privacy Policy.

NO ACCESS TO EMERGENCY SERVICES. Buble does not provide access to 112, the police, fire brigade, ambulance or other emergency services. Make sure that you and your child can always reach emergency services by telephone or other means. Buble is not intended for reporting urgent situations: in case of danger, call 112.

2. Who may use the Service; parental consent

  • Child account. A child account may only be created by a parent or legal guardian of that child (“Parent”). By creating a child account you declare that you are the Parent of the child, that you are authorised to act on behalf of the child, and that you accept these Terms and the Privacy Policy on your own behalf and on behalf of the child.
  • Age. Buble is intended for children aged 6 to 15, in the age groups 6-8, 8-10 and 10+; the Parent selects the group and keeps it up to date. A Parent must be at least 18 years old. We do not verify ages; you declare that the age group given is correct. When a child turns 16, the child account stays under your management until you delete it; Buble remains a service for children and offers no transition to an adult account of the child’s own. A child never accepts these Terms themselves: the Parent is and remains the contracting party for as long as the child account exists.
  • Legal basis for data processing. A child under the age of 16 cannot enter into a contract with us. You therefore enter into the contract as legal representative on behalf of your child. The processing needed to provide Buble rests on that contract. At present there is no feature for which we ask your separate consent as a parent (Article 8 GDPR); if one is introduced, we will ask for it separately and you can withdraw it at any time. The GDPR lets member states set an age threshold between 13 and 16; Buble applies the age of 16 throughout the EEA. The Privacy Policy sets out which legal basis applies to which processing.
  • Verification. We verify your e-mail address at registration. We do not verify your identity or your relationship to the child; your declaration that you are the Parent is the basis on which we create the child account. If that declaration proves incorrect, we may suspend or delete the child account.
  • Adult users. Parents and teachers have an adult account and accept these Terms themselves. Only a Parent can create a child account, and only for their own child; you declare that you are the Parent. An adult can be a child’s one-to-one contact, but only after that child’s Parent has approved the contact; that child’s Parent can read along with the adult’s messages to the child as described in section 3. An adult never uses the child account.
  • Groups, class groups and siblings. Your approval per contact also applies in groups: your child is only in a group with people you have approved, unless you turn on the per-child setting “may join groups with strangers” (off by default). You are notified when your child is added to a group or creates one, and you can remove your child from any group. Anyone who blocks someone will not end up in a group with that person. Class groups are the exception: a teacher linked to your child can put their pupils in one class group and can change some of the pupil’s settings; by linking a teacher you accept this for your child. Siblings with the same Parent are linked to each other automatically.
  • Shared custody. If custody of the child is exercised by more than one person, you declare that you have agreed the creation of the account with the other custodian(s).

3. Responsibility of the Parent

By agreeing to these Terms you, as Parent, expressly take on the following responsibilities:

  1. Safety and health of your child. You are responsible for the safety, wellbeing and physical and mental health of your child while using Buble. This includes deciding whether Buble is suitable for your child, setting appropriate restrictions, supervising use and guiding your child through what they encounter in the app.
  2. Contacts. You decide who your child is in contact with through Buble. You approve contacts only when you know who the person behind the account is; with every contact request you therefore see in advance the name and e-mail address of the requester (or of their Parent), and the other Parent likewise sees yours. We do not verify the identity of other users. You accept that the parent of every approved contact can read along in the same way you can: messages your child sends to a contact may be read by that contact’s Parent if they have turned on the read-along setting; in a group chat this applies to the Parents of all participants. In turn, the Parent of the other child accepts the same with respect to your child. If an approved contact is an adult, that adult accepts that you can read along with their messages to your child.
  3. Behaviour and content. You are responsible for everything done, sent or shared through the child account, whether or not you were aware of it, and for your child’s compliance with these Terms.
  4. Device and access. You are responsible for the device on which Buble is used, for securing the parent account (password) and for reporting misuse or unauthorised access to us at info@buble.app.
  5. Guidance. You read these Terms and the rules in section 5 together with your child and make sure your child knows how to report something via the shield and alert you, and that they can block an adult who is being unkind.
  6. Screen time and wellbeing. You monitor how long and when Buble is used and watch for signs that use is not good for your child. We provide tools (such as time limits) but do not decide how you use them.
  7. Confidentiality when reading along. What you read through the read-along setting also contains messages from other children. You use that information solely for the safety and guidance of your own child. You do not save, forward, share or publish these messages, not even in part or anonymised. The only exceptions are a report to us via the report button or info@buble.app, a report to the competent authorities, and a conversation with the Parent of the child concerned where that is in the interest of both children. The same applies to your child’s location: you use location tracking only for your child’s safety and do not share the location with others.

These responsibilities are the core of the agreement between you and us. Buble can only be a safe learning environment if the Parent stays actively involved.

4. Registration, devices and costs

  • Registration. You register with accurate, up-to-date information and keep it current. You may not create an account for a child of whom you are not the Parent.
  • Devices and software. You provide a suitable device, operating system and internet connection yourself. You agree to download and install updates and to receive service notifications needed to provide the Service.
  • Costs. Buble is free of charge. Data, internet and equipment costs are yours. If we offer paid features in the future, we will inform you in advance and the statutory right of withdrawal and additional terms will apply to them.

5. Permitted use and safety rules

  • Lawful and appropriate use. The Service may only be used for lawful, permitted and appropriate purposes and in accordance with these Terms and the rules in this section.
  • Prohibited conduct. Through Buble, in messages or in moments, it is not permitted to: (a) bully, threaten, intimidate or discriminate against others; (b) share sexual, violent, hateful or otherwise child-inappropriate content; (c) collect or share other people’s personal data without permission; (d) impersonate another person; (e) use a child account if you are not a child, other than as Parent through the parent account; (f) reverse-engineer, copy, modify or create derivative works of the Service; (g) distribute viruses or malicious code; (h) seek unauthorised access to the Service or to other people’s accounts; (i) create accounts by automated means; (j) resell or commercially exploit the Service; (k) abuse reporting channels with false reports.
  • What we do for safety. Conversations, including groups, are only possible with contacts the Parent has approved, unless the Parent turns on “may join groups with strangers”. Adults have a report and block button in every one-to-one conversation. Children have the shield: a safety report that goes to their Parents, teacher or trusted person, and they can block an adult (other than their own Parents). If a child names another child, the Parents of both children can message each other through Buble to discuss the situation. The Parent is notified when the child blocks someone, and of a safety report only if the child chooses “my parents” as recipient. For every child, regardless of age group, GIF and sticker searches always use the strictest content filter of our provider; the Parent can turn GIFs off entirely with the “share GIFs” switch, and for ages 6-8 they are off by default; a moment or comment reported three times by people who can see it is hidden automatically until a member of staff has reviewed it. We review reports and may remove content and suspend or terminate accounts. We only look into conversations when necessary to assess a report or to comply with a legal obligation.
  • Leaderboards. The Global and Regional game leaderboards show the display name, profile photo and score of adults, and of a child only if their Parent turns on the “visible in leaderboards” switch (off by default). No username or other way to make contact is shown.
  • Reporting. As an adult you can report inappropriate behaviour or content via the report button in the app or at info@buble.app. If you report a person from a one-to-one conversation, the last 10 messages between you and that person, including photos, videos and voice messages, are automatically sent with the report so we can assess it; the app warns you of this before sending. No copy is sent from a group conversation. Where we suspect sexual abuse, exploitation or other serious danger, we report this to the competent authorities.
  • Moments, comments and emoji reactions. A moment is visible to the child’s own contacts; Parents of those contacts see it only if they are themselves a contact of the child. Only the child who placed the moment can delete it. Contacts can comment and give an emoji reaction; comments are visible to everyone who can see the moment, emoji reactions only as a count without names. If the commenter is not your contact, you see the comment without a name or photo, as “Unknown user”. The prohibitions in this section also apply to comments. A comment can be deleted by whoever placed it and by the child who placed the moment. With the setting “share moments and comment” the Parent can turn off posting and commenting for the child; reading remains possible. Contacts may keep or forward a post; discuss with your child what they do and do not post.
  • Calls. Voice and video calls are only possible one-to-one between people who are also allowed to message each other, and are not recorded. The parent switch “calls” is on by default and determines whether the child can start a call.
  • Sharing location. Users aged 8 and over can share their location with a contact in a conversation, either fixed or live (for at most one hour); children aged 6-8 cannot. The parent switch “share location” is on by default and the Parent can turn it off. The Parent discusses with the child when this is and is not sensible; a shared location is visible to the recipient and their Parent like any other message.
  • Account security. You keep your device and accounts secure and report unauthorised use immediately.

How we handle a report. A report contains the content or account concerned and the reason. Our administrator assesses the report carefully and without undue delay; once a decision has been made, the reporter automatically receives an e-mail with the outcome. A decision to remove content or restrict an account is always taken by a member of staff; the automatic hiding of a moment or comment after three reports is temporary, until a member of staff has looked. If we take action against content or an account, the adult concerned, or for a child every linked Parent (never the child), automatically receives an e-mail stating the measure, the reason, the provision that was breached and how to object (section 11). In case of acute danger to a child or a legal obligation we may act immediately and inform afterwards.

6. Third-party services

Buble may connect with third-party services, such as the Apple and Google app stores, your device’s backup services and the GIF and sticker service Klipy; GIFs are loaded through our own server, so Klipy receives no data from your device. These Terms and our Privacy Policy apply only to Buble. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services.

7. Licences and intellectual property

  • Your rights. We do not claim ownership of the content you or your child share through Buble. You declare that you hold the necessary rights to that content.
  • Your licence to us. To provide the Service you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, store, copy, transmit and display content uploaded, sent, stored or received through Buble. This licence applies solely to providing, securing and improving the Service, for example to deliver messages and store them temporarily until delivered.
  • Our rights. All copyrights, trademarks, logos, software, designs and other intellectual property rights in Buble belong to Escarcha or its licensors. You may not use them without our express written permission.
  • Our licence to you. We grant you a limited, revocable, non-exclusive, non-sublicensable and non-transferable licence to use Buble in accordance with these Terms. No other rights are granted.
  • Reporting infringement. Notices of intellectual property infringement can be sent to info@buble.app. In case of repeated or serious infringement we may suspend or terminate an account.

8. Liability

8.1 What we are liable for without limitation. In accordance with the law, Escarcha is liable without limitation for damage resulting from death or personal injury attributable to it, for damage caused by intent or deliberate recklessness of Escarcha or its management, and for damage for which liability cannot be excluded or limited under mandatory law (including the rules on product liability).

8.2 Our care and what we do not guarantee. We provide Buble with the care that may be expected of a professional provider. We do not guarantee that Buble will work uninterrupted, error-free or completely securely, nor that unwanted contact, inappropriate content, bullying or other negative experiences will always be prevented or detected. Buble is a tool; supervision and guidance of the child rest with the Parent (section 3). We do not control and are not responsible for the conduct or content of other users or third parties.

8.3 What we are not liable for. Provided we have acted with the care referred to in section 8.2, we are not liable for: (a) damage not caused by a failure on our part, including damage caused by the conduct or content of other users or third parties; (b) damage that was not reasonably foreseeable to you and us when the contract was concluded; (c) damage caused by circumstances beyond our reasonable control, such as failures at hosting providers, networks, operating systems or app stores; (d) damage resulting from the Parent’s failure to meet the responsibilities in section 3 or the safety rules in section 5.

8.4 Limitation for other damage. For damage other than that referred to in section 8.1, our liability is limited to direct damage and to an amount of EUR 500 per event, where a series of related events counts as one event. Indirect and consequential damage, such as lost income or loss of data you could have backed up yourself, is excluded, except in the cases of section 8.1.

8.5 Consumer rights. This section does not limit the rights you have as a consumer under mandatory law, including the right to performance and repair of a defective service.

8.6 Reporting damage. To enable us to limit damage, you report a failure as soon as possible after discovering it, at info@buble.app.

9. Indemnification by the Parent

You indemnify the Escarcha parties (Escarcha and its directors, staff, shareholders and suppliers) against claims by third parties (including other users, their parents and public authorities) and against the resulting reasonable damage and costs, insofar as the claim results from: (a) a breach of these Terms or the safety rules by you or your child; (b) content you or your child shared through Buble that infringes the rights of others or is unlawful; (c) an incorrect declaration that you are the Parent of the child or are authorised to act on the child’s behalf. This indemnification does not apply insofar as the claim was caused by a failure on the part of Escarcha itself. We inform you promptly of any such claim, coordinate its handling with you and do not admit any claim without your agreement.

10. Disputes and governing law

These Terms and any dispute with Escarcha are governed by Dutch law, including the European law applicable in the Netherlands (such as the GDPR and European consumer rules). If you are a consumer living in another EEA country, you keep the protection of the mandatory law of that country and may bring a dispute before the competent court of that country. In all other cases the District Court of Midden-Nederland (Utrecht) has exclusive jurisdiction. If you have a complaint, contact us first at info@buble.app; we respond within 14 days. If we cannot resolve it together, you may submit the dispute to De Geschillencommissie (www.degeschillencommissie.nl), to a recognised dispute resolution body in your own country, or to the courts.

11. Availability and termination

  • Availability. We continuously work on Buble and may add, change or remove features and end support for devices or platforms. The Service may be interrupted for maintenance, repairs, updates or due to failures. We may discontinue the Service in whole or in part with 30 days’ notice; in urgent situations (abuse, legal obligations, security) no notice period applies. Force majeure, including failures at suppliers and networks, may affect the Service.
  • Termination by you. You may end the agreement at any time by first deleting each child account via the Family tab and then your own account via Profile > Delete account. Deletion is immediate and irreversible (see the Privacy Policy, section 9).
  • Termination by us. We may warn, restrict, suspend or terminate an account where we reasonably suspect a breach of these Terms, where there is danger to a child or other users, in case of unlawful conduct, or where required by law. For less serious breaches we first give a warning and an opportunity to remedy; for serious or repeated conduct, or in case of acute danger, we may terminate immediately. For every restriction, suspension or termination the user sees on login that the account is suspended, and the adult concerned, or for a child every linked Parent, automatically receives an e-mail stating the measure, the reason and the provision that was breached. You may object within six months at info@buble.app; the objection is reviewed by a member of staff who was not involved in the original decision, and you receive a reasoned decision within 14 days. If the measure proves unjustified, we reverse it.
  • Surviving provisions. Sections 7, 8, 9, 10, 11 and 12 survive termination.

12. Other provisions

  • These Terms and the Privacy Policy form the entire agreement between you and us regarding Buble and replace any earlier arrangements. The Child Safety Policy (buble.app/safety) and the Parental Consent Policy (buble.app/consent) explain these Terms; in the event of a difference, these Terms prevail.
  • These Terms and the Privacy Policy carry a version number. We may change them. For a material change our administrator e-mails all adult users in advance and the app asks every adult user to accept again before the app can be used further; if you do not agree, you may delete the account. For minor changes, the changed Terms apply if you continue to use the Service after the effective date. We record which version you accepted and when (see the Privacy Policy).
  • We may transfer our rights and obligations to a group company or in the context of a merger, acquisition or sale; we will inform you of this and personal data will only be transferred in accordance with the law. You may not transfer your rights and obligations without our written consent.
  • Nothing in these Terms prevents us from complying with the law. If we do not enforce a provision, we do not waive our right to do so.
  • If a provision is void or unenforceable, it will be replaced by a valid provision that comes as close as possible to its intent; the remaining provisions remain in force.
  • We may freely use feedback and suggestions without compensation.
  • These Terms and the Privacy Policy are written in English, and the English text is the binding version. We may provide translations for convenience; translations are AI-generated and labelled as such, and in the event of any difference the English text prevails.
